The judiciary is one of the three powers of the state, according to which disputes between individuals and each other and between them and the state, whether they are natural or legal persons, are settled. The litigation system is not immune to the boom of technical progress and the novelty of technology. The time has come to keep pace with this development by developing litigation systems to move forward towards an electronic judicial system that complements the presence and objectives of the e-government.
The presence of reservations about the development of this system because of the security failures that it may suffer in particular, and the trust of individuals in the traditional system, given that we are accustomed to practicing it, And the fear of defects during modernization delays our presence in the ranks of developed countries that care for people and are based on serving them, and here specifically through the integrity of legislation and ease of procedures, especially those related to litigation. Moreover, the defects that litigation systems may encounter are defects that can be avoided when there are organized legislation, tools, programs and strong networks.
Remote litigation is an electronic process that enables us and the litigant in particular to file, initiate, follow up and plead his case through an electronic system specified by the state and under the supervision of the competent authorities before all judicial authorities in the Sultanate. It aims to simplify the litigation procedures; This process is based on necessary needs, starting from drawing up the legal and regulatory framework for it, to having powerful electronic tools and programs in order to maintain the security and quality of the system.
The Sultanate is already making moves towards developing the litigation system, whether through the experience of the Public Prosecution in the Sultanate or through the texts of the law simplifying and facilitating litigation procedures issued by Decree No. 125/2020, which simplified the issue of advertising and some other matters, or through the moves of the Supreme Judicial Council and the Administrative Council towards activating the role of technology and incorporate it into its procedures in a large way, This is only a clear translation of the implementation of the Oman 2040 vision, which qualifies us for the future in all fields.
Some models of judicial systems that preceded us in development reflect the magnitude of the positive impact and the effectiveness of performance. Having considered their experiences, we conclude the reason for the urgency of the call and demand that our judicial systems keep pace with the requirements and nature of the times, Although there are great efforts that seek to achieve this, it seems that this global epidemic, the Corona pandemic, may God protect us and everyone from it, has played a fundamental role and formed pressure and motivation not only for us but for various countries in the matter of activating modern technology, Perhaps harmful and beneficial, especially when we turn adversity into grants.
